Terms of Service, Kisumu Pest Control

Please read these Terms of Service ("Terms") carefully before using the services, products, training programs, website, or other offerings provided by Kisumu Pest Control ("we", "us", "our", or "Kisumu Pest Control"). These Terms govern your access to and use of our services and form a binding agreement between you ("you", "Client", or "User") and Kisumu Pest Control. By requesting, booking, purchasing, or using our services or products, you accept and agree to these Terms.
If you do not agree to all of these Terms, please do not use our services, purchase our products, or access our training programs.
1. Scope and applicability
These Terms apply to:
- Pest control services (one-off treatments, scheduled programs, emergency response).
- Sale and supply of products (pesticides, mosquito nets, sanitary bins, protective gear, and other materials).
- Training courses, exams, and certifications offered by Kisumu Pest Control.
- Use of our website, booking systems, mobile applications, and any online tools we provide.
Specific written contracts, service agreements, or supplier agreements signed between you and Kisumu Pest Control may contain additional or alternative terms that take precedence for that transaction. These Terms apply in addition to such contracts unless otherwise stated.
2. Definitions
- Client / You / User: Any person or organization that books, purchases, or uses our services, products or training.
- Services: Inspections, treatments, re-treatments, monitoring, prevention programs, and any associated work performed by Kisumu Pest Control.
- Products: Tangible items sold or supplied by Kisumu Pest Control (e.g., nets, chemicals, bins, PPE).
- Booking / Order: A request or confirmed appointment for services or a purchase order for products.
- Website: The official online presence of Kisumu Pest Control, including any booking or payment pages.
3. Booking, confirmation, and scheduling
- Bookings may be made via phone, email, website, or in person. A booking becomes confirmed once we send a confirmation message (email, SMS, or WhatsApp) or issue an invoice.
- You must provide accurate contact information, property details, and any relevant access instructions. We are not liable for missed appointments or delays caused by incorrect information supplied by you.
- We will make reasonable efforts to meet requested appointment times but cannot guarantee exact arrival times. For urgent or emergency calls we will prioritize based on availability.
4. Client obligations and safety
- You must provide full and accurate information about the property, pest history, and any special considerations (children, pets, medical conditions, sensitive equipment).
- For chemical treatments you must follow pre-treatment and post-treatment instructions we provide (e.g., vacating premises, covering food, removing fish tanks). Failure to follow instructions may reduce treatment effectiveness and may limit remedies available under these Terms or our Refund/Warranty policies.
- You must secure or remove items that could be harmed by treatment (e.g., exposed food, sensitive plants) unless otherwise agreed.
- Access: you are responsible for ensuring access to the property at the scheduled time. If access is denied at the scheduled time or you fail to be present for an agreed appointment, cancellation fees may apply.
5. Service descriptions, estimates, and changes
- We will provide clear descriptions of services, treatment plans, and pricing in quotes or invoices. Estimates are based on information available at the time and may be revised if further issues are discovered during inspection.
- Additional or unexpected work (e.g., structural repairs, major proofing, extensive exclusion work) will be quoted separately and require your authorization before proceeding.
- We reserve the right to refuse or limit services where safety, legal compliance, or ethical considerations make provision inappropriate (for example, unsafe premises, illegal product requests).
6. Products and warranties
- Products sold by us are subject to the product terms shown at point of sale and to the manufacturer’s warranties where applicable. Defective products reported within the stated return window will be repaired, replaced, or refunded according to our Refund Policy.
- Some products are non-returnable for safety or hygiene reasons (opened chemical containers, used sanitary bins, custom-made items). We will clearly identify non-returnable items at sale.
7. Pricing, payments, and invoices
- Prices are as quoted on booking confirmation, invoice, or price list. Prices may vary for emergency calls, weekend work, or services requiring special equipment.
- Payments may be made by the methods we accept (mobile money, bank transfer, card, cash). We may require deposit or full prepayment for certain services, products, or training enrollments.
- Invoices are payable by the due date. Late payments may incur interest or fees and may result in suspension of scheduled services until payment is made. We reserve the right to withhold certificates, course results, or product deliveries until outstanding invoices are settled.
8. Cancellations and refunds
- Client cancellations and our cancellation rights are governed by the cancellation terms stated in your booking or service agreement and by our Refund Policy. Please review those documents for details on cancellation windows, administrative fees, and refund eligibility.
- We may cancel or reschedule services due to staff illness, safety concerns, severe weather, or other operational constraints. Where we cancel a booked service we will offer a rescheduled appointment or a refund for any prepaid amounts for the canceled service.
9. Guarantees, warranties, and re-treatment
- Some services include warranty or guarantee terms (for example, termite treatment warranties or contractually agreed re-treatment periods). Warranty details will be confirmed in writing at the time of sale.
- Warranties typically require client cooperation with aftercare instructions (sanitation, proofing, not altering exclusion work) and may exclude pest activity resulting from conditions outside our control. Where a covered issue arises within warranty, we will usually re-treat at no additional cost. If repeated re-treatment fails, refund options may be available as described in our Refund Policy.
10. Limitation of liability
- To the fullest extent permitted by law, our total liability for any claim arising from or in connection with the services, products, or these Terms is limited to the amount you paid for the specific service or product that gave rise to the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business, or loss of income, except as required by applicable consumer protection laws.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify, defend, and hold harmless Kisumu Pest Control and its officers, employees, contractors, and agents from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising from:
- Your breach of these Terms;
- Your negligence or willful misconduct;
- False or misleading information you provide; or
- Claims brought by third parties arising from your use of our services or products.
12. Subcontracting and third-party providers
- We may engage subcontractors or third-party providers to perform parts of the service (e.g., logistics, specialized treatments). We remain responsible for the overall service quality and compliance with these Terms.
- Where subcontractors perform on-site work, you authorise reasonable access and cooperation with those subcontractors.
13. Health, safety, and permitted products
- We use approved products and follow safety protocols. You must disclose any sensitive conditions, protected species on-site, or equipment that may be affected by treatments.
- We will not use banned substances or unapproved methods. Requests for prohibited items or methods will be refused.
14. Intellectual property
- All content on our website, training materials, manuals, images, logos, and branding remain the property of Kisumu Pest Control or its licensors. You may not reproduce, distribute, or use our intellectual property without express written permission.
- Course participants may receive course materials licensed for personal or organizational training use; redistribution is prohibited unless expressly authorized.
15. Training courses, exams, and certification
- Enrollment, cancellation, and refund terms for training are set out at registration and in our course-specific terms. Certificates are issued on successful completion and subject to verification of attendance, exam results, and compliance with course rules.
- Misconduct, plagiarism, cheating, or falsification of attendance/exam records may result in disqualification and denial of certification without refund.
16. Privacy, data protection, and communications
- Our collection and use of personal data are governed by our Privacy Policy. By using our services or website you consent to the collection and processing of personal data in accordance with that policy.
- You consent to receive service-related communications (appointment confirmations, safety instructions) and, where you have opted-in, marketing communications. You may opt-out of marketing messages as described in the Privacy Policy.
17. Force majeure
- We are not liable for failure or delay in performing our obligations where such failure or delay is caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, strikes, pandemics, government actions, acts of terrorism, or supply chain disruptions. We will notify affected clients and make reasonable efforts to reschedule services.
18. Termination
- Either party may terminate a contract for material breach where the breach remains uncured after a reasonable notice and opportunity to remedy.
- We may suspend or terminate services and withhold products or certificates if you fail to pay invoices, obstruct our staff, or behave abusively towards our personnel. Termination shall not relieve you of the obligation to pay for services and products already provided.
19. Dispute resolution
- We aim to resolve disputes amicably. If you have a complaint about service or products, please contact our customer support so we can investigate and attempt resolution.
- If internal resolution fails, we will seek mediation. If mediation is unsuccessful, disputes may be referred to the courts of competent jurisdiction in Kenya. These Terms are governed by the laws of Kenya.
20. Notices
- Notices to us should be sent to the contact details published on our website. Notices to clients will be sent to the email, phone number, or postal address provided at booking and are effective upon dispatch.
21. Changes to terms
- We may update these Terms from time to time to reflect changes in law, business practice, or services. The revised Terms will be published on our website with an updated “Last revised” date. Continued use of our services after publication constitutes acceptance of the updated Terms.
22. Severability
- If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
23. Entire agreement
- These Terms, together with any written service agreement, quote, invoice, Refund Policy, Privacy Policy, and any other documents expressly incorporated by reference, constitute the entire agreement between you and Kisumu Pest Control relating to the subject matter and supersede prior communications or agreements.
